Nadex Amends Rules 2.10 Consent to Jurisdiction, 9.2 Investigations, Hearings, and Appeals, and 9.3 Settlement of Investigations

Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and section §40.6(a) of the regulations promulgated by the Commodity Futures Trading Commission (the “Commission”) under the Act (the “Regulations”), North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”) has provided to the Commission its intent to amend its Rule 2.10 (Consent to Jurisdiction) to clarify that jurisdiction under the Rule is continuing, Rule 9.2 (Investigations, Hearings, and Appeals) to note that information and documents which were public prior to the commencement of an investigation will remain public, and Rule 9.3 (Settlement of Investigations) to better align its procedures during settlement negotiations with the industry standard. These changes will become effective on September 9, 2019.
